·1. Introduction

• 1.1. The use of this www.vsgaming.co.za & www.digitalgamingleague.co.za ("the Site") is subject to the following conditions and any person entering the Site is bound by these conditions.
• 1.2. "User" means any person who enters and/or uses the Site, notwithstanding the fact that such a person only visits the home page of the Site.
• 1.3. The Site is owned by VS Gaming PTY Limited (Herein after referred to as VS Gaming) whose principal place of business is at 61 Oak Avenue, Highveld, Centurion, Pretoria, Gauteng.

• 2.1. Whilst every reasonable effort is made to ensure that the information contained on the Site is accurate and up to date, it should not be assumed that this will invariably be the case. Where necessary or appropriate, Users should obtain independent verification of any information contained on the Site.
• 2.2. News articles and/ or opinions published on the Site reflect the views of the author. VS Gaming does not necessarily associate itself with any of the views or opinions expressed by the authors of any news articles or opinions published on the Site.
• 2.3. VS Gaming reserves the right to change any of the content on the Site at any time in its sole discretion.

• 3.1. The Site is owned and operated by VS Gaming which has copyright in respect of all material contained on the Site, unless otherwise stated. No content may be altered, distributed, transferred, added to, or in any other way interfered with, except as otherwise expressly indicated on the Site or with the prior written consent of VS Gaming. In the event that VS Gaming gives its permission for the reproduction of any copyright material contained on the Site, VS Gaming or copyright holder, as the case may be, must be credited as the copyright holder in a prominent place and in legible letters.
• 3.2. If copyrighted material is to be reproduced on another website, then the first occurrence of the words “VS Gaming” must be hyperlinked to the Site at the author/writers  own cost.
• 3.3. Comments and suggestions about the Site are welcome. By making such suggestions or comments, the person making such comments and / or suggestions release all intellectual property rights to such comments or suggestions to VS Gaming at no charge.
• 3.4. Third Parties may submit articles for publication on the Site. Authors of such articles are required to identify themselves and provide a brief curriculum vitae. VS Gaming reserve the right to edit such articles or quote extracts from them, allow the articles or extracts thereof to be reproduced on other websites and in other places, in VS Gamings discretion, provided that the author will always be credited.
• 3.5. All intellectual property on the Site, including but not limited to content, trademarks, logos, pictures, video downloads, domain names, patents, design elements, software, source code, meta tags, databases, text, graphics, icons and hyperlinks are the property of or licensed to VS Gaming and as such, are protected from infringement by domestic and / or international legislation and treaties. Subject to the rights licensed to the User, all other rights to intellectual property on the Site are expressly reserved

·4. Breach

• 4.1 If any User uses content from the Site in breach of these Terms and Conditions
  • 4.1.1 VS Gaming reserves the right to claim damages from the User and/or
  • 4.1.2 to institute criminal proceedings against the User.

·5. Conditions of Use

• 5.1. Hyperlinks to the Site from any other source shall be directed at the home page of the Site. Links beyond the Site’s home page may only be used with VS Gaming prior written consent.
• 5.2. VS Gaming shall not be liable, in any manner whatsoever, for any damage, loss or liability that resulted from the use of content, products or services available from the Site, if such content, products or services was accessed through a hyperlink not directed at the home page of the Site. Persons that wish to link to pages beyond the home page of the Site without VS Gaming prior written consent, they shall do so at their own risk and hereby indemnify VS Gaming against any loss, liability or damage that may result from the use of such hyperlinks. VS Gaming non-liability for deep linking is based on the fact that deep links bypass these terms and conditions.
• 5.3. Users may refer to small and reasonable amounts of content available from the Site and only if such a reference is placed in inverted commas and acknowledged.
• 5.4. No person may, without the prior written consent of VS Gaming, frame the Site in any manner whatsoever.
• 5.5. Apart from bona-fide search engine operators and use of the search facility provided on the Site by Users, no person may use or attempt to use any technology or applications (including web crawlers, robots or web spiders) to search, collect or copy content from the Site for any purpose whatsoever, without the prior written consent of VS Gaming. No modification and/or reverse engineering whatsoever of any content of this website is permitted.
• 5.6. E-mail addresses, names, telephone numbers and fax numbers published on the VS Gaming website may not be incorporated into any database used for electronic marketing or similar purposes. No permission is given or should be implied that information on the VS Gaming website may be used to communicate unsolicited communications to VS Gaming and all rights detailed in section 45 of the ECT Act - http://www.acts.co.za/ect_act/ are reserved.
• 5.7. All licenses and / or permissions granted in terms of this clause 5 are provided on a non-exclusive and non-transferable basis and may be terminated or cancelled by VS Gaming at any time without prior notice or reasons.

·6. Hyperlinks

• 6.1. The Site provides links to various other Internet sites. VS Gaming has no control over the content of those websites, nor does VS Gaming review that content. VS Gaming therefore cannot be held responsible for the content or the accuracy of those websites. These websites may contain sexually explicit, violent, racist, or other types of material which may be offensive to the User. Therefore, access to such other websites is at the Users discretion and risk.

·7. Limitation of Liability and warranties

• 7.1. VS Gaming does not guarantee the accuracy of information provided on the Site and accordingly cannot accept any liability for any loss or damage of any nature, howsoever caused, that may arise from your use of the Site or reliance upon information contained in it.
• 7.2. Where information of a financial nature is contained on the Site, this is provided for information purposes only and the User is advised not to place reliance upon such information for purposes of their own financial, investment, tax planning or decisions. VS Gaming does not guarantee the accuracy of such information or that the information provided is current.
• 7.3. VS Gaming does not and cannot guarantee that files available for download from the Site or that the Site as a whole is free of viruses, worms, Trojan horses or other code that has contaminating or destructive properties. Accordingly, the use of the Site is at the Users own risk.
• 7.4. VS Gaming shall not be liable, in any manner whatsoever, for any damage, loss or liability that resulted from the use of such content by the User or any third party who obtained any content from the User.

·8. Privacy Policy

• 8.1. VS Gaming recognises and respects the Users right to privacy. Accordingly, where we obtain personal information about Users we are committed to the protection of that information and its appropriate use.
• 8.2. In certain cases, when using the Site, Users may be requested to provide us with personal information. Other information about Users may also be obtained automatically as Users navigate through the Site. This includes, but is not necessarily limited to Internet protocol address, the software that being used using to browse the Internet and User domain addresses. This may assist us to manage the Site and provide functionality to the User. We do not use this information for direct marketing or solicitation of business from visitors to the Site.
• 8.3. "Cookies" accessed or stored by the Site may retain personal information including your name, e-mail address, postal address and telephone number, but Users have the choice to switch off "cookies" on their computer. Any "cookie" used by the Site is not accessible to other websites.
• 8.4. No personal information gathered by VS Gaming about Users will be shared with any other person or entity, save as provided in this privacy statement or as required by law.
• 8.5. We do not send spam.
• 8.6. The security of Users personal information is protected by secure firewall and database architecture. Users personal information may only be accessed by VS Gaming personnel who have a legitimate business reason to do so and personal information can be made public or private by editing your profile settings. Please however be aware that should there be communication between VS Gaming and Users over the Internet, such communications can be accessed by other Internet users. Therefore, Users should not use e-mail to communicate with us should Users wish to include information in that communication that is required to be kept confidential.

·9. Competitions

• 9.1. All competitions run by VS Gaming on the Site are subject to conditions applicable to particular competitions, which will be specified.

·10. General

• 10.1. Any dispute arising from the use of or reliance on the Site will be subject to the jurisdiction of the law and the courts of the Republic of South Africa.
• 10.2. VS Gaming reserves the right to change these conditions at any time without prior notice.
• 10.3. The head notes to the clauses of these conditions are for reference purposes only and shall in no way govern or affect the interpretation of, nor modify or amplify the terms of these conditions.

Telkom Comic Con Cape Town Competitions

Terms & Conditions

• 1.    Competition Rules:
  • 1.1.    This promotional competition (“Competition”) is organised and run by Telkom SA SOC Ltd (Registration Number 1991/005476/30), a listed company duly registered in accordance with the laws of the Republic of South Africa, with its registered address at Telkom Park the Hub, 61 Oak Avenue, Techno Park Highveld Centurion, Pretoria (“Telkom”) including its affiliates, partners, associations, and agents (“Organisers”).
  • 1.2.     By entering this Competition all participants agree to abide by the following competition regulations listed below:
• 2.    Competition Period:
  • 2.1.    The Competition commences from 10:00am on 27 April 2023 till 18:00 on 30 April 2023. 
  • 2.2.    The duration of the Competition may be extended or curtailed at the discretion of the Organisers. Any such amendment will be communicated via Telkom Social Media pages.
• 3.    Who is eligible to win a prize:
  • 3.1.    Persons (“Participants”) interested in entering the Competition must:
    • 3.1.1.    be a natural person;
    • 3.1.2.    be a South African citizen or a permanent resident with a valid identity document or passport and reside in South Africa;
    • 3.1.3.    have participated in the Competition as per clause 4 below during the Competition Period;
  • 3.2.    Employees of the Telkom Group and their immediate families, advertising and promotion agencies, distribution partners, associated companies, outlet owners, and their immediate families and staff associated with this Competition are not allowed to enter the Competition.
• 4.    To participate: 
  • 4.1.    To enter the Competition Participants must participate in person at the Telkom VS Gaming stage at the Comic Con Cape Town Event which will be hosted at the Cape Town International Convention Centre during the Competition Period. 
  • 4.2.    Entries for this Competition will only be accepted if they comply with the Competition mechanic to be displayed at the event and posted on the Telkom VS Gaming Website. No late entries will be accepted. 
• 5.    The structure of the competitions to be hosted:
  • 5.1.    Throughout the weekend at Comic Con Cape Town the following events will take place: 
    • 5.1.1.     Daily Single Elimination Cups: 
      • Participants will have the opportunity to play FIFA23 on PS5 consoles while also being able to sign up for short single elimination cups. Entries are on a first come first serve basis, each 32-player elimination bracket will be filled as per the time that the person signed up. If a participant wins the Single Elimination, they will be eligible for a prize.
    • 5.1.2.     Daily King of the Hill 
      • During the free to play & sign-up, Participants will have the opportunity to take part in daily King of the Hill events. Participants will be seated at one of the available consoles where they will compete against other opponents. If a Participants wins a match, they will remain seated and play another match against another opponent. If a person loses a match, they will fall out of the event but will be allowed to return to the queue to participate again at a later stage. If a person manages to stay in a seat and win 3 consecutive matches, they will be deemed a king of the hill winner and will be eligible for a prize.
    • 5.1.3.     Racing Simulator
      • Participants will have the opportunity to sign up and set their fastest lap times. There will be a standing leader board where the top 10 times are showcased. The Participant who sets the fastest lap of the day will be eligible to win a prize whilst the Participant that set the fastest lap for the weekend will be eligible to win a Grand Prize. 
• 6.    Prizes
  • 6.1.    The Prizes applicable to the different events are the following: 
    • 6.1.1.     FIFA Single Elimination:  
    • Each winner of a FIFA Single Elimination Cup event will, at the Promotor’s discretion, be awarded any one of the following prizes:   
      • 6.1.1.1.    A R3000 New Balance Voucher
      • 6.1.1.2.    Energade Boost
      • 6.1.1.3.    R500 Cash Voucher**
    • 6.1.2.     FIFA King of the Hill:
      • 6.1.2.1.    Each winner of a FIFA King of the Hill event will, at the Promotor’s discretion, be awarded a R250 Cash Voucher**.  
    • 6.1.3.     Racing Simulator
    • Each winner of a Racing Simulator event will, at the Promotor’s discretion, be awarded any one of the following prizes:   
      • 6.1.3.1.    A JBL Gaming Headset
      • 6.1.3.2.    Energade Boost
      • 6.1.3.3.    R1000 Cash Voucher**
      • 6.1.3.4.    The Participant that sets the fastest lap time for the duration of the tournament will be eligible to win a Grand Prize consisting of a Logitech G Racing Simulator.
  • 6.2.    The prizes are not transferable, cannot be deferred or exchanged, or redeemed for cash, and are not negotiable.
  • 6.3.    Telkom reserves the right to substitute any, or part of any, of the prizes.
  • 6.4.    Winners will be notified at the event or via SMS/WhatsApp to the number provided during registration.
  • 6.5.    Winners will need to respond with their requested details within 24 hours of being notified via private message, thereafter, the prize will be forfeited and awarded to the next runner-up winner. 
  • 6.6.    Should you be chosen as a winner, Telkom will request to have your name, photographic images, or video used for marketing and publicity campaigns.
  • 6.7.    Telkom will not be responsible for any costs and/or expenses that a winner, or any participant, may incur during and to enter the Competition, similarly, Telkom will not be responsible for charges associated with a winner accepting and/or using a prize. 
  • 6.8.    Participants will be restricted to one prize per event, the different events being the following:
    • 6.8.1.    FIFA – Single Elimination Cup
    • 6.8.2.    FIFA – King of the Hill
    • 6.8.3.    Racing Simulator
  • 6.9.    In other words, once a Participant has won a prize in any of the above-mentioned events, they will not be eligible to win a prize competing in the same event.
  • 6.10.    **In the event of a Prize winner receiving a Cash Voucher, such winners will be requested to provide a valid South African bank account (either personal or that of a guardian) for the purposes of payment.  Payment of the cash amount will not happen during the Competition Period and will only be paid once all the relevant information has been received and on completion of an auditing process.  Telkom will not entertain any dispute in this regard and the Participant must ensure that the correct information was provided for this purpose. 
• 7.    General:
  • 7.1.    The rules of the Competition may be amended at any time during the Competition Period and any such amendments will be published on the website, once published the amendments will be deemed accepted.
  • 7.2.    All rules will be interpreted and applied at the sole discretion of Telkom.  
  • 7.3.    Participants take part in the Competition at their own risk and Telkom bears no responsibility for any loss, damage or harm suffered because of the participation and/or acceptance and/or use of a prize, or any aspect thereof.
  • 7.4.    Telkom reserves the right to cancel the Competition at any time, if deemed necessary in its opinion or if circumstances arise that are outside of its control and will not be liable to Participants in such event for any cause or action whatsoever. 
  • 7.5.    Any violation or attempt to violate any of these rules will result in the immediate disqualification of the transgressor with or without notice. 
  • 7.6.    The announcement of a winner does not constitute a ruling by Telkom that the winner has complied with these rules. Telkom may disqualify a Participant after the announcement, should any rule transgressions be discovered. The Prizes will be awarded as per clause 6 above, and the judge's decision is final, and no correspondence will be entered into.
  • 7.7.    A copy of these terms and conditions can be found at www.digitalgamingleague.co.za and/or on any of Telkom’s social media platforms throughout the Competition Period.
  • 7.8.    The terms and conditions applicable to this Competition will be construed, interpreted, and enforced by the applicable laws of the Republic of South Africa.
